Please read these Terms carefully before using IdentifyTCM. By using this service, you agree to be bound by these Terms.
1. Service Description
- • IdentifyTCM is an AI-powered TCM constitution assessment and wellness subscription service operated by Jimmy Yu.
- • The service includes: an online constitution assessment quiz, a personalised constitution analysis report (delivered by email), and daily wellness emails tailored to your constitution, local solar terms, and weather.
- • All content is for general wellness reference only and does not constitute medical diagnosis, treatment recommendations, or medical advice. This service is not a substitute for a licensed healthcare professional.
2. Eligibility
- • You must be at least 18 years of age to use this service.
- • By using this service, you represent that you have the full legal capacity to enter into a binding agreement.
3. Subscriptions & Payment
- • Both the Monthly Plan ($19.99/month) and Annual Plan ($129/year) are auto-renewing subscriptions.
- • Subscription fees are charged automatically at the start of each billing cycle.
- • All payments are processed securely by Stripe. Your card details are managed directly by Stripe — we never store your card number.
- • Currency and pricing are as displayed at checkout.
4. Cancellation
- • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; the service remains active until then.
- • To cancel, log in to your account settings, or email acupuncturistjimmyofficial@gmail.com.
- • After cancellation, you will no longer receive daily wellness emails.
5. Refund Policy

6. Intellectual Property
- • All service content — including the constitution analysis framework, email templates, prompt design, and website design — is protected by copyright and owned by IdentifyTCM.
- • You may not copy, distribute, modify, or commercially use any service content. Content is provided for your personal use only.
- • AI-generated personalised wellness guidance is generated for your individual use and may not be redistributed.
7. Limitation of Liability
- • The service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of continuity, accuracy, or fitness for a particular purpose.
- • To the maximum extent permitted by law, IdentifyTCM is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the service.
- • You bear personal responsibility for any health outcomes resulting from following service recommendations. Please consult a licensed healthcare professional for health concerns.
8. Governing Law
- • These Terms are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes shall first be resolved through good-faith negotiation.
9. Changes to Terms
- • We reserve the right to modify these Terms. Material changes will be notified to active subscribers by email at least 14 days before taking effect. Continued use of the service constitutes acceptance of the updated Terms.
